A settlement has been reached in a class action lawsuit involving allegations that Gap Outlet, Gap Factory Store or Banana Republic Factory Store (collectively, “Gap”) used false or misleading reference prices. Gap vigorously denies the allegations, and the court has not decided who is right. If, you have made an in-store or online purchase from Gap Outlet, Gap Factory Store or Banana Republic Factory Store between May 24, 2010 and May 10, 2019 and have not received a refund or credit for all of your purchases, you may be able to receive one or more $6 Settlement Purchase Certificate(s) if you submit a Claim Form.
If you did not receive direct notice of this Settlement via email, or did receive direct notice and want to obtain a Settlement Purchase Certificate(s), you must submit a Claim Form. To receive a Settlement Purchase Certificate, you must file a qualifying claim. Claim Forms may be filed online by clicking here and are available for download on the Important Documents page of this website. Claim Forms must be submitted or postmarked by January 6, 2020. If you don’t want to be legally bound by the settlement, you must exclude yourself by September 23, 2019, or you won’t be able to sue Gap about the legal claims in the action ever again. If you exclude yourself, you cannot receive a Settlement Purchase Certificate from this settlement. If you stay in the settlement, you may object to it by September 23, 2019. The Court will hold a hearing on October 11, 2019 to consider whether to approve the Settlement, subject to the additional conditions explained in the Notice.

The Court in charge of this Action has preliminarily approved the Settlement and must decide whether to give final approval to the Settlement. The relief provided to Class Members will be provided only if the Court gives final approval to the Settlement and, if there are any appeals, after the appeals are resolved in favor of the Settlement.
